I. Terms and Conditions
§ 1 Basic Provisions
The following terms and conditions apply to contracts concluded between you and us as the seller (Heinz-Peter Hebbel) via the website hockey.hps-sport-shop.de. Unless otherwise expressly agreed, the inclusion of any terms and conditions used by you is hereby rejected.
A consumer within the meaning of these terms is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.
An entrepreneur is any natural or legal person or a legally capable partnership acting in the exercise of their independent professional or commercial activity when concluding a legal transaction.
§ 2 Conclusion of the Contract
The subject of the contract is the sale of goods.
By listing a product on our website, we submit a binding offer to conclude a purchase contract under the conditions stated in the product description.
The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the “shopping cart”.
The customer can view and modify the shopping cart at any time.
After clicking “Checkout” or “Proceed to Order” and entering personal details, an order summary is displayed.
When using instant payment systems (e.g. PayPal, Sofort, Amazon Pay, giropay), the customer may be redirected to the respective payment provider.
On the order summary page, all details can be reviewed and corrected.
By clicking “order with obligation to pay”, “buy now”, “pay” or a comparable button, the customer legally accepts our offer.
Enquiries outside the shopping cart system are non-binding. A binding offer in text form will be provided and may be accepted within five days.
Contract processing is carried out via email, partly automated. The customer must ensure that the provided email address is correct and that receipt is not blocked by spam filters.
§ 3 Special Agreements on Payment Methods
SEPA Direct Debit:
When paying by SEPA direct debit, the customer authorises us to collect the invoice amount from the specified account.
The advance notice period is reduced to five days.
Any bank charges resulting from insufficient funds shall be borne by the customer.
§ 4 Right of Retention, Retention of Title
The customer may only exercise a right of retention if it arises from the same contractual relationship.
The goods remain our property until full payment has been made.
§ 5 Warranty
The statutory warranty rights apply.
Consumers are advised to inspect the goods immediately upon delivery for completeness, obvious defects and transport damage and to notify us promptly of any complaints.
Failure to do so does not affect statutory warranty rights.
Deviations from objective requirements are only deemed agreed if the customer was informed prior to conclusion of the contract and the deviation was expressly agreed.
§ 5a Additional Services and Right of Withdrawal
For individually performed services (e.g. skate sharpening, mounting, adjustments or other irreversible services), there is no right of withdrawal pursuant to Section 312g (2) No. 1 BGB once the service has been fully performed.
In the event of withdrawal, the goods will be accepted back; however, the costs of services already performed are non-refundable.
§ 5b Custom-Made or Personalised Goods
Goods manufactured according to customer specifications, personalised or clearly tailored to personal needs (e.g. MyBauer custom sticks, team apparel, name and number printing, special productions, customer-specific modifications) are excluded from withdrawal pursuant to Section 312g (2) No. 1 BGB.
Returns are only accepted in the case of proven defects within the scope of statutory warranty.
§ 5c Liability for Improper Use
We assume no liability for damage caused by improper use, excessive stress, incorrect installation, manipulation or use contrary to the intended purpose.
Normal wear and tear does not constitute a defect.
§ 6 Choice of Law
German law shall apply.
For consumers, this applies only insofar as mandatory provisions of the country of habitual residence are not overridden.
The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
§ 7 Freight Forwarding & Non-Parcel Goods
Bulky or heavy goods are delivered by freight forwarding companies.
Shipping costs are calculated individually and communicated to the customer prior to order completion.
Returns by freight forwarding are at the customer’s expense unless a statutory defect exists.
§ 8 Delivery, Investigations & Transfer of Risk
If a shipment is marked as “delivered” by the carrier, the goods are generally deemed delivered.
In case of uncertainties, an investigation will be initiated.
During the investigation period, there is no entitlement to immediate refund or replacement.
§ 9 International Deliveries & Returns from Non-EU Countries
For deliveries outside the European Union, additional costs (customs duties, import VAT, clearance fees) may apply and must be borne by the customer.
Customs and import charges incurred for outbound shipping will not be refunded in the event of withdrawal.
Returns from non-EU countries are always at the customer’s expense.
Any customs or clearance costs incurred again upon return shall also be borne by the customer.
VAT Refund for Non-EU Deliveries:
A refund of German VAT (e.g. for customers from Switzerland) is granted exclusively under the following conditions:
VAT refunds are processed only from a minimum amount of EUR 40.00.
Invoice amounts below this threshold will be accumulated until the minimum amount is reached.
A prerequisite is the submission of the export invoice stamped by customs, either
in original form, or
as a clearly legible scanned document.
A complete bank account reference must be provided for the transfer of the refund amount.
No entitlement to VAT refund exists without full documentation and bank details.
§ 10 Discount Codes & Promotions
Discount codes cannot be combined unless expressly stated otherwise.
Subsequent application to completed orders is excluded.
§ 11 Pricing Errors & Obvious Mistakes
In the event of obvious pricing or technical errors, there is no entitlement to delivery at the incorrect price.
Any payments already made will be refunded in full.

The contract language is German.
The full contract text is not stored by us. Before submitting the order, customers may print or save their order data.
After submitting an order, all relevant data will be sent to the customer by e-mail.

4.1. We comply with the Käufersiegel quality criteria of Händlerbund Management AG.
4.2. We comply with the quality criteria of Trusted Shops GmbH.
