I. Terms & Conditions
§ 1 Basic Provisions
The following Terms & Conditions apply to all contracts concluded between you as the customer and us as the supplier (Heinz-Peter Hebbel) via the website hockey.hps-sport-shop.de.
Unless expressly agreed otherwise, we do not accept any of your own terms and conditions.
A “consumer” is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business, or profession.
An “entrepreneur” is any natural or legal person or partnership acting in the course of their trade or professional activity.
§ 2 Conclusion of Contract
The subject of the contract is the sale of goods.
By listing a product on our website, we make a binding offer to conclude a purchase contract under the conditions stated in the product description.
A contract is formed via the online shopping cart system as follows:
The products intended for purchase are placed in the shopping cart.
The customer can view and modify the shopping cart at any time.
By clicking “Checkout" or “Proceed to Order” and entering personal data, a final order overview is displayed.
If an instant payment method (PayPal, Sofort, Amazon Pay, giropay, etc.) is selected, the customer may be redirected to the payment provider’s website.
The customer may review and amend all order details on the order overview page.
By clicking “Place Binding Order”, “Buy Now”, “Pay Now” or similar wording, the customer accepts our offer, and a legally binding contract is concluded.
Requests for personalised offers outside the cart system are non-binding. We send a binding offer in text form that may be accepted within 5 days.
Order processing takes place via e-mail. The customer must ensure the accuracy of the e-mail address and the technical ability to receive our messages.
§ 3 Special Provisions for Available Payment Methods
SEPA Direct Debit
By choosing SEPA direct debit, the customer authorises us to collect the invoice amount from the specified account.
The pre-notification period is reduced to 5 days.
Fees arising from returned direct debits due to insufficient funds are borne by the customer.
§ 4 Right of Retention, Retention of Title
A right of retention is only permitted if it relates to claims from the same contractual relationship.
Goods remain our property until full payment has been received.
§ 5 Warranty
Statutory warranty rights apply.
Consumers are advised to check the goods immediately upon delivery for completeness, visible defects, and transport damage, and to notify us and the carrier as soon as possible.
Failure to do so does not affect statutory warranty rights.
Deviations from the objective quality requirements are only deemed agreed if the customer was expressly informed and consented before placing the order.
§ 5a Additional Services (e.g. Skate Sharpening) and the Right of Withdrawal
For additional customised services (e.g. skate sharpening, mounting, adjustments, or any service that cannot be undone), the right of withdrawal expires as soon as the service has been fully performed, in accordance with Article 246a § 1 EGBGB in conjunction with § 312g (2) No. 1 BGB.
In case of a withdrawal of the goods order (e.g. skates), the product will be accepted as a return; however, the cost of the performed service will not be refunded, as the service cannot be reversed.
§ 5b Customised or Personalised Goods (e.g. MyBauer, Teamwear, Name/Number Printing)
Goods manufactured to customer specifications or clearly tailored to personal requirements — including but not limited to:
MyBauer Custom Sticks
Teamwear
Name and number printing
Special production
Custom modifications
are excluded from the right of withdrawal pursuant to § 312g (2) No. 1 BGB.
Returns are only accepted in the event of proven defects under statutory warranty laws.
§ 5c Liability for Improper Use
We assume no liability for damage caused by improper use, excessive force, incorrect installation, unauthorised modification, or use contrary to the product’s intended purpose.
This applies in particular to:
hockey sticks (e.g. slashes, impacts, material overload)
skates
protective equipment
helmets
goalie equipment
Normal wear and tear does not constitute a defect.
§ 6 Choice of Law
German law applies.
For consumers, this only applies insofar as it does not deprive them of mandatory protections granted by the law of their country of residence.
The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
§ 7 Freight Shipping & Non-Parcel-Sized Goods
Bulky or heavy items (e.g. hockey goals, mats, rink boards, training equipment) are shipped via freight forwarding.
Freight costs are calculated individually based on size, weight, and destination.
Customers receive the freight cost information before completing the order or upon request.
Freight return shipping is at the customer’s expense unless a statutory warranty claim applies.
§ 8 Delivery, Tracking, Investigations & Transfer of Risk
If a shipment is marked as “delivered” by DHL, DPD, UPS, FedEx, or similar providers, the order is generally considered delivered.
If discrepancies arise, an official investigation (trace request) will be initiated.
During the investigation period, there is no entitlement to immediate refund or replacement.
Risk transfers to consumers only upon physical delivery, except where the customer independently commissions a carrier not chosen by us.
§ 9 International Deliveries & Returns from Non-EU Countries
For deliveries outside the EU, additional charges (duties, taxes, customs handling fees) may apply and must be paid by the customer.
Customs and import fees incurred during outbound shipping will not be refunded in case of withdrawal.
Return shipments from non-EU countries are always at the customer’s expense.
Any customs or processing fees that arise during the return shipment must also be borne by the customer.
§ 10 Discount Codes & Promotional Offers
Discount codes cannot be combined unless explicitly stated.
Retroactive application of discount codes to completed orders is excluded.
Promotions apply only during the stated period and only for the products included in the promotion.
Discounted items may be excluded from further promotions.
§ 11 Pricing Errors & Obvious Mistakes
In the event of obvious pricing errors or technical mistakes in the shop, there is no entitlement to delivery at the incorrect price.
We reserve the right to cancel affected orders.
Payments already made will be refunded in full.

The contract language is German.
The full contract text is not stored by us. Before submitting the order, customers may print or save their order data.
After submitting an order, all relevant data will be sent to the customer by e-mail.

4.1. We comply with the Käufersiegel quality criteria of Händlerbund Management AG.
4.2. We comply with the quality criteria of Trusted Shops GmbH.

6. Prices and Payment Conditions

6.1. All prices include all applicable taxes.
6.2. Shipping costs are displayed separately during the ordering process.
6.3. For deliveries outside the EU, additional charges may apply.

6.6. Unless otherwise stated, payments are due immediately after contract conclusion.
